US Court Mandates Release of Kilmar Abrego Garcia from ICE Custody
A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without legal authority.
"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.
The case originates in a erroneous removal to El Salvador in March, which US authorities later acknowledged was an error. Following his repatriation to the United States to answer human smuggling charges, he was held in federal custody.
In her order, the judge noted that the authorities lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
